These Terms of Service ("Terms") govern your access to and use of the GiftEase website, mobile application, and related services (collectively, the "Services"), operated by GiftEase, Inc. ("GiftEase," "we," "our," or "us").
By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Eligibility
You must be at least 13 years old (or older if required by applicable law) to use the Services.
Account Registration & Responsibilities
You may need to create an account and provide accurate information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Acceptable Use
You agree not to:
• Use the Services for unlawful, harmful, or fraudulent purposes
• Interfere with or disrupt the Services
• Reverse engineer or attempt to extract source code
• Circumvent security or access controls
• Infringe the rights of others
User Content & Third-Party Information
The Services may allow you to submit information, including information about friends or family members ("User Content").
You choose what information to save about others and are responsible for the content you enter through the Services. You retain ownership of your User Content and grant GiftEase a limited, non-exclusive, royalty-free license to use it solely to operate, provide, and improve the Services.
SMS Messaging
If you opt in, GiftEase may send SMS messages related to your account, product updates, and reminders. Message frequency may vary. Message and data rates may apply. You may opt out at any time by replying STOP. Reply HELP for assistance. GiftEase is not responsible for delayed or undelivered messages due to carrier issues.
Intellectual Property
All content, software, trademarks, logos, and branding on the Services are owned by or licensed to GiftEase and protected by intellectual property laws. You may not copy, distribute, or create derivative works without permission.
Payments & Subscriptions (If Applicable)
If you make purchases through the Services, payments are processed by third-party providers. GiftEase is not responsible for their errors, policies, or security practices. Fees are non-refundable unless otherwise stated.
Termination
We may suspend or terminate access to the Services if you violate these Terms or misuse the Services. You may stop using the Services at any time.
Disclaimers
The Services are provided "as is" and "as available," without warranties of any kind. We do not guarantee uninterrupted service or error-free recommendations.
Limitation of Liability
To the fullest extent permitted by law, GiftEase will not be liable for indirect, incidental, or consequential damages. Our total liability will not exceed the greater of $100 or the amount you paid to GiftEase in the prior 12 months.
Indemnification
You agree to indemnify and hold harmless GiftEase from claims arising out of your use of the Services, your violation of these Terms, or your User Content.
Governing Law
These Terms are governed by the laws of the State of Delaware.
Dispute Resolution
Disputes will be resolved by binding arbitration under AAA rules, except for eligible small-claims matters. You waive the right to participate in class actions.
Changes to These Terms
We may update these Terms. Continued use after changes means you accept the revised Terms.
